The Nest Aluminum Pergola Warranty


We stand by the quality and craftsmanship of our aluminum pergola systems, providing a comprehensive warranty to ensure your investment is protected. To ensure the integrity of the product all installation, repairs, adjustments must be performed by our Authorized personnel to maintain warranty's validity.


Below are the full details of our warranty coverage, exclusions, terms and remedies.


1. Warranty Coverage for Aluminum Parts and Structural Extrusions


This warranty covers aluminum components including columns, base plates and beams and structural extrusions used in the product, for
10 years  from the date of installation by The Nest approved personnel or delivery, whichever occurs first.  The terms of this coverage are as follows:


Coverage Details:


  • The warranty applies to defects in materials and workmanship under normal use and proper maintenance.
  • Covered defects include:
  • Cracking, warping, or deformation of aluminum components due to manufacturing defects.
  • Corrosion, rust, or material degradation not caused by environmental factors excluded in the warranty terms.
  • Failure of structural integrity within specified design parameters.


Exclusions:


  • Improper installation, modification, or alteration by unauthorized personnel.
  • Exposure to corrosive substances, such as saltwater or industrial chemicals.
  • Overloading or exceeding weight-bearing capacity of the structure.
  • Environmental factors, such as corrosion or degradation caused by extreme weather or pollutants.
  • Normal wear and tear, such as cosmetic scratches or fading over time.


Customer Responsibilities:


  • Customers are responsible for ensuring proper maintenance of aluminum parts and components, including regular cleaning and inspection (at least every six months ) to prevent accumulation of debris or corrosive materials.



2. Warranty Coverage for Mobile Elements (Louvers, Hand Crank Mechanisms)


This warranty covers mobile elements, including louvers and hand crank mechanisms, for 5 years  from the date of installation by The Nest approved personnel or delivery, whichever occurs first.  The terms of this coverage are as follows:


Coverage Details:


  • Includes defects in materials and workmanship for:
  • Louvers: Movable slats providing shading and ventilation.
  • Hand Crank Mechanisms: Manual systems operating louvers or adjustable elements.
  • Covered defects include:
  • Failure of louvers to open, close, or adjust as intended under normal use.
  • Malfunctioning or breakage of hand crank mechanisms due to manufacturing defects.
  • Misalignment or jamming of louvers caused by improper assembly during manufacturing.


Exclusions:

  • Improper use, abuse: Overexertion, forced operation, or overloading mechanisms.
  • Improper installation, modification, repairs or alteration by unauthorized personnel.
  • Environmental factors, such as corrosion warping or degradation caused by extreme weather, chemicals, saltwater or pollutants.
  • Lack of proper maintenance or lubrication.
  • Normal wear and tear, such as minor squeaking, loosing or surface scratches that does not affect functionality.


Customer Responsibilities:

  • Regularly clean and lubricate components (at least every six months) to remove debris, dirt and other obstructions.
  • Avoid forcing mechanisms beyond their designed limits.
  • Proper storage when not in use.


3. Warranty Coverage for Automatic Motors, Remote Controls, and LED Lights


This warranty covers automatic motors, remote controls, and LED lights for 2 years from the date of installation by The Nest approved personnel or delivery, whichever occurs first.  The terms of this coverage are as follows:


Coverage Details:


  • Includes defects in materials and workmanship for:
  • Automatic Motors: Failure to operate or adjust movable elements, overheating, jamming, or internal component failures caused by manufacturing defects.
  • Remote Controls: Non-responsiveness due to hardware or programming issues.  Failure to communicate with the motorized system within the specified range.
  • LED Lights: Premature burnout, flickering or failure to function as specified.


Exclusions:


  • Improper use, such as overloading motors outside their intended operational limits.
  • Dropping, mishandling, misplacing or using remote controls in ways that void manufacturer specifications.
  • Environmental damage, such as water intrusion or exposure to extreme temperatures.
  • Electrical surges not caused by the product itself.
  • Improper wiring or installation by unauthorized personnel.
  • Normal wear and tear, such as battery depletion in remote controls or gradual dimming of LED lights.


Customer Responsibilities:


  • Follow operational guidelines in the user manual.
  • Use appropriate voltage and amperage for motors and lighting systems.
  • Store remote controls in a safe, dry location.


Preventative Maintenance Services:

Claims Process:


To file a claim under this warranty, customers must provide written notice of the defect, along with supporting documentation (e.g., photos, videos, proof of purchase, maintenance records), within 30 calendar days  of discovering the defect.  Access and permission may be requested by The Nest from the customer to schedule a physical review of the defect.


Remedies:


If a defect is identified within the warranty period and is covered under these terms, the manufacturer or installer will, at their discretion:

Repair the defective component.

Replace the defective component with a comparable new or refurbished item.

Refund the purchase price of the defective component, excluding installation or labor costs.


4. Additional Warranty Terms & Definitions


Any repairs, adjustments and installation must be performed by Authorized personnel to maintain warranty's validity. 


Authorized personnel are individuals who have been specifically approved and trained by The Nest to assess, install, repair, or adjust components of the pergola system. These individuals possess the necessary expertise, tools, and knowledge to ensure that all work is performed in accordance with The Nest’s standards and specifications. Customers must contact The Nest directly to schedule services with Authorized personnel. Any work performed by individuals not approved by The Nest will void the warranty for the affected components.


Non-Transferability:

The warranty for your pergola system is non-transferable, meaning it applies exclusively to the original purchaser and the location where the product was initially installed. If the property is sold, the ownership of the property changes, or the pergola system is moved from its original installation location, the warranty will no longer be valid.


Labor Coverage:

Labor is covered for the first year following installation for warranty-covered defects.  Labor costs for diagnosing, repairing, or replacing warranty-covered defects are fully covered during the first year following installation. After the first year, labor charges will apply for any work performed. To ensure transparency, we will provide you with a general estimate of the costs for the required work and will request your written approval before proceeding. This process ensures you have complete clarity and control over any labor expenses.


Exclusions Term definitions:

Extreme Weather Conditions, including but not limited to: High winds, storms, hurricanes, heavy snowfall, or flooding exceeding design limits.

UV Degradation, including but limited to: Fading, warping, or material weakening from prolonged sun exposure.

Acts of God, including but limited to: Natural disasters such as earthquakes, landslides, and wildfires.

Environmental Hazards, including but not limited to: Corrosion or damage from salt spray, industrial pollutants, or pests.

Improper Use: Using the system outside its intended purpose.


Limitations of Liability:

Liability is limited to repair, replacement, or refund of defective parts at the manufacturer’s discretion.  The warranty does not cover incidental or consequential damages, including costs for disassembly, reassembly, transportation, loss of use or inconvenience caused by defective components.  The manufacturer’s total liability under this warranty is limited to the original purchase price of the defective component.
